HB 181 Summary

• Requires county recorders to make electronic recording available for real property conveyances and other instruments by January 1, 2025, and to publish electronic indexes and versions of recorded instruments on their websites.

• Modifies powers of attorney requirements to allow same-day execution and recording of powers of attorney with real property instruments, and permits late recording with supporting affidavits under specific conditions.

• Updates judgment lien procedures to require last known addresses (not post office boxes) of judgment debtors and clarifies filing and indexing requirements in county recorder offices and courts.

• Establishes mortgage subrogation rights allowing new mortgages to assume priority of satisfied prior mortgages when parties intend such priority and subordinate lienholders expect to remain junior.

• Appropriates $8 million ($6.5 million General Revenue Fund, $1.5 million Dedicated Purpose Fund) to reimburse counties for electronic record modernization costs through the County Recorder Electronic Record Modernization Program.
