Amends Ohio Revised Code section 3101.01 to permit marriage between two persons regardless of sex, replacing the existing language that limited marriage to one man and one woman.

Repeals existing state law provisions that declared same-sex marriages void and against Ohio's public policy, including provisions that refused recognition of same-sex marriages performed in other jurisdictions.

Enacts new section 3101.011 prohibiting Ohio and its political subdivisions from prohibiting marriage between individuals of different races.

Retains existing restrictions on marriage including age requirement of 18 years, kinship restrictions (not nearer than second cousins), and prohibition on persons with existing spouses.

Maintains exceptions for extending specific statutory benefits to nonmarital relationships between same-sex or different-sex couples that are not expressly limited to married persons, and preserves validity of private agreements.
