H.B. 376 - Kidfluencer Protection Act

• Requires vloggers featuring minors to maintain detailed records including minor identities, compensation amounts, and video minutes, with annual reporting to minors by March 1st.

• Mandates vloggers deposit at least one-half of the earnings percentage (based on screen time) for each featured minor into a trust account by March 1st annually, with funds available only when the minor reaches age 18 or is declared emancipated.

• Requires online platform operators to provide itemized statements to account holders showing vlog-generated compensation details, including whether funds are connected to content featuring minors.

• Allows publishing minors (those whose likeness appears in at least 30% of compensated content within 30 days earning at least one-tenth cent per view) to enforce compensation requirements and recover actual damages, punitive damages, and attorney's fees.

• Permits persons who qualified as vlogging minors to request permanent deletion of vlogs containing their likeness, name, or photograph from online platforms after reaching age 18 or being declared emancipated.
