H.B. No. 410 Summary

• Defines "deepfake media" as an image, audio, or video recording created with intent to deceive that appears to depict a real person speaking or acting in a manner they did not actually perform.

• Prohibits knowing creation and dissemination of deepfake media for influencing election results without disclosure: images must include written statement of manipulation in readable font size, audio recordings must include spoken statements at beginning, end, and every two minutes for recordings over four minutes long, and video recordings must display written manipulation statement for entire duration.

• Bans creation and dissemination of deepfake media for election influence during the 90-day period before an election through election day, regardless of disclosure.

• Allows persons harmed by violations to pursue civil action against violators for compensatory and punitive damages, in addition to any other statutory or common law remedies.

• Amends section 3599.40 to exclude violations of the new deepfake media law from the general misdemeanor of the first degree penalty provision applicable to other election law violations.
