H.B. No. 419 - Universal Background Checks Act

• Requires all firearm transfers between unlicensed individuals to be conducted through a federally licensed firearms dealer or law enforcement agency, with limited exceptions for temporary transfers, hunting, shooting ranges, and law enforcement transfers.

• Mandates background checks for unlicensed firearm transfers, including compliance with federal law (18 U.S.C. 922(t)) and state incompetency records checks through the attorney general's office.

• Allows federally licensed firearms dealers and law enforcement agencies to charge a fee of up to $10 per firearm transfer processed.

• Establishes criminal penalties for violations: misdemeanor of the fourth degree for first offense, second degree for second offense, and first degree for three or more offenses.

• Amends Section 5122.311 to authorize the attorney general to provide incompetency records checks to federally licensed firearms dealers and law enforcement agencies pursuant to the new background check requirements.
