H.B. No. 429 - Traffic Offenses in Construction Zones

• Enacts section 4511.993 to impose enhanced penalties for traffic violations committed in construction zones, including fines of $400 (first offense), $800 (second offense), or $1,200 (third+ offense), plus mandatory safe driving courses and driver's license suspensions up to one year.

• Enhanced penalties only apply when a construction zone sign is posted, a construction worker is present in the zone, and the offense is corroborated by at least two witnesses or video from body/dash/roadside camera.

• Defines "construction zone" as lanes or portions of streets/highways where construction, reconstruction, resurfacing, or repair work is being conducted, from the first worker/equipment location to the last.

• Authorizes the director of transportation to establish variable speed limits within construction zones based on work type, time of day, or other appropriate criteria.

• Requires the department of transportation to adopt rules and design specifications for signs advising motorists of increased penalties in construction zones, and allows private contractors to install speed monitoring devices after consulting with the department or local jurisdiction.
