Licensed residential facilities may elect to permit residents to install and use electronic monitoring devices in their rooms, subject to facility policies and other residents' consent requirements.

Residents or their guardians/attorneys in fact must complete facility-prescribed authorization forms and pay all costs for installation, maintenance, and removal of monitoring devices.

If a resident shares a room or unit, consent from other residents or their guardians/attorneys in fact is required before installation; facilities must attempt reasonable accommodations if consent is refused.

Licensed residential facilities are released from liability for privacy violations related to electronic monitoring devices, and residents cannot be denied admission or discharged based on their decision to use monitoring devices.

Only the resident, guardian/attorney in fact, law enforcement, the facility, and authorized government investigators may view or listen to recorded images or sounds; residents cannot authorize others to view recordings containing other residents unless requested by investigating authorities.
