Amends Ohio Revised Code sections 3794.01 and 3794.03 to add a new exemption from the statewide smoking ban for cigar bars.

Defines "cigar bar" as an establishment deriving more than 15% of gross revenue from cigar sales, accessories, and humidor rentals, located in a freestanding structure where smoke cannot migrate to other enclosed areas.

Cigar bars may hold a liquor permit under Ohio law and still qualify for the exemption if they meet the structural and revenue requirements.

Cigar bars must annually file an affidavit with the Ohio Department of Health by January 31st certifying the percentage of gross income derived from cigar product sales and related fixtures.

The smoking ban still applies to cigar bars regarding all other forms of smoking besides cigars.
