S.B. No. 103 - Kratom Consumer Protection Act

• Defines "kratom product" as food containing any part of a leaf from the plant Mitragyna speciosa.

• Requires food processing establishments and retail food establishments to register kratom products with the director of agriculture before processing, manufacturing, or selling them.

• Prohibits kratom products that contain poisonous ingredients, controlled substances, synthetic alkaloids, or 7-hydroxymitragynine levels exceeding one percent of alkaloid composition; requires labels stating mitragynine and 7-hydroxymitragynine amounts.

• Bans sale of kratom products to individuals under 18 years of age.

• Establishes civil penalties for violations and allows individuals to bring civil lawsuits for damages; violations involving reckless conduct are misdemeanors of the second degree.
