S.B. No. 263 - Braden's Law Summary

• Creates two new sexual extortion offenses: "sexual extortion" (felony of third, second, or first degree depending on circumstances) and "aggravated sexual extortion" (felony of third, second, or first degree with possible additional prison term of up to ten years) involving threats to release private images to compel acts, induce crimes, obtain additional images, or obtain anything of value.

• Defines "aggravated sexual extortion" as sexual extortion activity targeting persons under age 18 or that causes great bodily harm or death, with specific penalty enhancements for repeat offenders.

• Allows family members of victims of aggravated sexual extortion resulting in death to receive compensation from the crime victims compensation fund, expanding victim eligibility under existing reparations provisions.

• Provides immunity from liability for providers of information services, interactive computer services, and telecommunications services that comply with court orders related to sexual extortion investigations or prosecution.

• Establishes that persons or children who disseminate their own private images as a direct result of sexual extortion victimization cannot be convicted or adjudicated delinquent for that dissemination.
