Am. S.B. No. 63 Summary

• Requires plaintiffs in tort actions alleging asbestos claims to file a sworn statement within 60 days of filing a complaint, signed by the plaintiff or their counsel, specifying evidence for each claim against each defendant.

• Sworn statement must include plaintiff's personal information (name, address, date of birth, marital status, occupation, smoking history, current and past worksites and employers), information about witnesses knowledgeable about exposures, and details about each asbestos-containing product involved.

• For each exposure, plaintiff must disclose the specific sites and locations where exposure occurred, beginning and ending dates, manner of exposure, frequency, length, and proximity of the product to the exposed person.

• Plaintiff cannot commence discovery against a defendant until the defendant's product or premises is specifically identified in the required disclosures; courts must dismiss claims without prejudice if a defendant's product is not identified or if plaintiff fails to comply, unless plaintiff shows good cause.

• Plaintiff has a continuing duty to supplement disclosed information when new exposure history is received or prior disclosures are discovered to be inaccurate or incomplete; section does not apply to workers' compensation or veterans' benefits claims.
