Ohio Department of Medicaid must notify applicants about the Medicaid Estate Recovery Program twice: once upon application and again when the application is approved.

The first page of Medicaid applications must include a statement that the enrollee's estate may be subject to recovery after death, a list of covered services, and the per-member-per-month capitation payment amounts paid to managed care organizations.

The department must create a consumer-focused plain-language notification explaining how estate recovery works, including example scenarios, developed with input from Medicaid consumers.

Enrollees at risk of estate recovery must receive a separate notification listing available support resources such as legal aid and estate planning services.

Eligibility determination notices must include information on how to file complaints, check benefit status, and disenroll from Medicaid.
