Creates new state crime of "unlawful presence in the state" for persons unlawfully present in the United States who knowingly enter or remain in Ohio, punishable as a 4th or 5th degree felony with a mandatory 12-month prison term and fines of $500-$1,000

Requires law enforcement agencies to participate in federal immigration enforcement programs, report suspected undocumented immigrants to ICE within 24 hours of arrest, and detain individuals for up to 48 hours for transfer to federal custody

Mandates detention facilities notify ICE within 24 hours of admitting anyone reasonably believed to be unlawfully present in the U.S., and requires courts to notify ICE when suspected aliens are convicted of any offense

Provides affirmative defense for DACA recipients approved between June 15, 2012 and July 16, 2021, and allows case stays for defendants awaiting asylum determinations or visa renewals

Withholds state local government fund payments from counties, townships, and municipalities whose law enforcement agencies fail to comply with the act's immigration enforcement requirements, with $500 deducted per instance of noncompliance
