Medical marijuana processors that held a certificate of operation on or before December 7, 2023 become eligible to receive one adult use dispensary license, one medical dispensary license, and one level III adult use cultivator license at designated locations

Qualifying processors must not have transferred their processor license or control of operations after December 7, 2023, and cannot have any common ownership or control with a cultivator

Level III adult use cultivator license holders who obtain licenses through this new pathway gain authority to cultivate medical marijuana and sell it to licensed processors, in addition to cultivating adult use cannabis

The Division of Cannabis Control may issue up to 40 level III adult use cultivator licenses total, with no person allowed ownership or control in more than one such license

License applicants holding only a medical provisional license must obtain a certificate of operation within two years of December 7, 2023 to qualify for the new licenses
