Department of Education and Workforce must withhold all state foundation funding from any school district that files or joins a lawsuit challenging the state's calculation or distribution of foundation funding, including funding for state scholarship (voucher) programs

Withheld funds are transferred to a newly created State Foundation Funding Escrow Fund in the state treasury, administered by the Department of Education and Workforce

Districts only receive their withheld funding after the lawsuit is terminated or the district withdraws from the legal action

Appropriates funds for fiscal years 2026 and 2027 to allow release of escrowed funds when litigation concludes

Expenditures are subject to applicable provisions of H.B. 96 of the 136th General Assembly (the state budget bill)
