Data centers withdrawing state waters must submit monthly reports to the chief of the division of water resources detailing total water consumption, maximum daily amounts, water sources, and whether water was used for cooling or other purposes.

Annual reports are due by February 1 each year and must include total yearly water consumption plus descriptions of efficiency measures taken to reduce water use.

Data centers are prohibited from entering nondisclosure agreements with political subdivisions that restrict officials or employees from commenting on the data center's water consumption information.

Violations of the nondisclosure agreement prohibition carry a civil fine of up to $1,000, enforceable by the attorney general, and any such agreements are void and unenforceable.

The chief of the division of water resources must compile annual data reports and submit them to the Ohio House and Senate natural resources committees within 30 days of preparation.
