Requires all new drive-through facilities (restaurants, pharmacies, financial institutions) to include an adjacent by-pass lane at least 10 feet wide alongside each drive-through lane

By-pass lanes must allow customers to exit the drive-through lane and enable public safety vehicles to access vehicles in emergencies

Existing drive-through facilities undergoing major renovations, expansion, or redevelopment must also comply with the by-pass lane requirement

Exempts facilities built before the effective date where there is insufficient space or compliance would force closure, and facilities where the drive-through passes through the building structure

Violations not detrimental to health, safety, or welfare are subject to fines up to $100; violations that are detrimental constitute a minor misdemeanor
