Utility providers conducting work for health, safety, or public benefit may seek permission from local governments instead of railroad companies when encroaching on or near railroad rights-of-way

Municipal legislative authorities have approval power for encroachments within their territory; county commissioners have authority for encroachments outside municipal boundaries

Local governments must provide reasonable notice to affected railroad companies before granting permission to utility providers

Enacts new section 4963.50 of the Ohio Revised Code, overriding any conflicting state law provisions
