Data centers must obtain a consumptive use permit from the Chief of the Division of Water Resources before withdrawing any Ohio waters, in addition to any other required permits

Data centers are prohibited from withdrawing more than an average of 5 million gallons of water per day over any 30-day period

Data center owners/operators must pay all direct and indirect water and sewer infrastructure costs incurred by utility systems due to the data center's establishment and operation; other ratepayers cannot be charged for these costs

Permits will be revoked if water withdrawal exceeds the permitted quantity, and may be suspended if continued withdrawal endangers public health, safety, or welfare

Violations constitute a fourth-degree misdemeanor, with fines deposited into the state water management fund; six or more Ohio residents may petition for investigation of alleged permit violations
