Increases the per se THC threshold for OVI violations from 2 nanograms to 5 nanograms per milliliter in whole blood, and eliminates urine and blood serum/plasma as testing methods for THC concentration violations

Establishes new "inference of impairment" THC levels: 25 ng/mL in urine, 2-5 ng/mL in whole blood, or 5 ng/mL in oral fluid, which allow a trier of fact to infer marijuana impairment without requiring expert testimony

Removes marijuana metabolite testing as a basis for per se OVI violations, requiring instead the presence of active THC (tetrahydrocannabinol)

Clarifies that evidence regarding analysis methods, reliability, and equipment used in chemical testing remains admissible under the Rules of Evidence and is subject to Expert Testimony Rule 702

Applies identical changes to both vehicle OVI laws (Section 4511.19) and watercraft/boating under the influence laws (Section 1547.11)
