HB 1613 Summary

• Expands confidential treatment of work papers, recorded information, and documents produced during insurance examinations and analysis by the Insurance Commissioner to be kept private and not subject to subpoena or public disclosure.

• Grants the National Association of Insurance Commissioners access to confidential examination materials when they agree in writing to maintain the same confidential treatment, unless the company provides prior written consent.

• Clarifies that confidentiality protections do not extend to identical, similar, or related documents not in the Commissioner's possession, custody, or control.

• Applies confidentiality requirements to work papers used in analyzing insurance company financial conditions, audited financial reports, actuarial opinions, discount medical plans, insurance administrators, and risk-based capital reports.

• Becomes effective November 1, 2010.
