ENGR. H. B. NO. 2089 - Summary

• Amends 19 O.S. Section 746 to limit county jail liability for medical care costs to non-preexisting conditions that arise from county acts or omissions.

• Defines preexisting conditions as those receiving treatment or diagnosed in the 6 months before arrest, or accidental injuries sustained during that same period.

• Allows inmates with preexisting conditions to receive necessary medical care but requires the inmate to pay all associated costs including medication, treatment, and transportation.

• Directs sheriffs to reimburse health care providers using the Oklahoma Medicaid Fee Schedule rates and prohibits paying fees or charges exceeding the scheduled rate.

• Effective date: November 1, 2009.
