Modifies the Oklahoma Higher Learning Access Program by requiring use of "nonguaranteed resident tuition" rather than guaranteed tuition when determining student awards at Oklahoma State System institutions.

Changes financial qualification thresholds for program participation: reduces initial enrollment threshold from $50,000 to $43,000 adjusted gross income (minus exemptions), and maintains $100,000 threshold at postsecondary enrollment.

Establishes higher income thresholds for adopted students ($150,000-$200,000 depending on adoption age) to maintain program eligibility.

Takes effect July 1, 2009, with emergency provisions making it effective immediately upon passage and approval.
