HB2509 Summary

• Modifies the Solid Waste Management Advisory Council from nine to ten members with four appointments by the Governor, three by the Speaker of the House, and three by the President Pro Tempore of the Senate, adding representation for the solid waste incineration and waste-to-energy industry.

• Extends solid waste management fee requirements and regulations to commercial incinerators in addition to landfill disposal sites, including requirements for scales, waste recording, and quarterly fee reporting.

• Changes the maximum reimbursement limit for wheel wash system capital investment costs from $300,000 to $50,000 per fiscal year and extends the deadline for claiming reimbursement to January 1, 2012.

• Adds exemption from solid waste fees for ash produced from combustion in commercial incinerators and authorizes the Department to use fee income for incentive payments to entities generating steam from commercial incinerators.

• Allows the Department to apply surplus wheel wash reimbursement funds toward closure costs of abandoned landfills that lack sufficient financial assurance and whose operators cannot be identified or compelled to close them properly.
