HB2919 - Aircraft Pilot and Passenger Protection Act

• Creates the Aircraft Pilot and Passenger Protection Act to regulate obstructions to air navigation near public-use airports in Oklahoma, protecting aircraft pilots, passengers, and ground residents.

• Requires permits from the Oklahoma Aeronautics Commission before constructing structures near public-use airports that exceed 150 feet above airport elevation within 3 statute miles, or that breach horizontal, conical, or approach surfaces.

• Exempts structures for incompatible purposes (residences, schools, hospitals, places of worship) from primary surfaces and runway protection zones, which are presumed incompatible with airport operations.

• Mandates recording of issued permits with county clerks within 30 business days, with permits valid for 10 years from issuance; permits become final 30 days after notification unless applicant requests reconsideration.

• Establishes penalties of up to $500 per violation with each day of violation as separate offense; authorizes Commission to charge up to $200 per permit application and promulgate implementing rules; effective October 1, 2010.
