HB 3056 Summary

• Modifies the Emergency Management Interim Legislative Succession Act by reducing the maximum number of emergency interim successors each legislator must designate from seven to five, while maintaining a minimum of three successors.

• Requires legislators to submit designations to the Chief Clerk of the House or Secretary of the Senate when sworn into office, and mandates designations be filed with the Secretary of State to become effective.

• Prohibits more than one emergency interim successor from being related within the third degree of affinity or consanguinity to the designating legislator.

• Changes oath administration for emergency interim successors from legislative leaders to Justices of the Supreme Court or other authorized persons, and only requires oaths if the successor actually assumes legislative duties.

• Establishes penalties for emergency interim successors who falsely hold themselves out as legislators, with violation subject to false personation charges under Oklahoma law; effective November 1, 2010.
