HB 3160 Summary

• Amends 11 O.S. 2001, Section 36-202 to require concurrence from owners of property zoned for agricultural use before such property can be assessed for street improvement costs.

• Maintains the existing requirement that owners of more than one-half the land area in a proposed improvement zone may petition for street, alley, lane, or avenue improvements of at least one block in length.

• Requires petitions to include bold, capitalized notice that improvement costs will be assessed against benefited property, and to describe the improvement character, width, preferred materials, and ownership of affected land.

• Preserves the municipal governing body's authority to determine petition sufficiency, conduct hearings, and compel witness testimony, with a 15-day limit for legal challenges to their findings.

• Declares an emergency effective date for the act to take effect immediately upon passage and approval.
