Section 183 of 56 O.S. 2001 is amended and designated as "Kelley's Law" relating to confidentiality of applications and records for applicants and recipients of Department of Human Services assistance.

All applications, information, and records concerning applicants or recipients remain confidential and accessible only to authorized Department personnel or as authorized by law.

Department of Human Services must maintain a process allowing authorized representatives of clients to access confidential information necessary for eligibility determination and appeals.

The Developmental Disabilities Services Division must require all authorized persons accessing service recipient information to sign a form certifying they understand penalties for misuse of confidential information, including criminal penalties related to identity theft.

Unauthorized furnishing of records for commercial or political purposes is a misdemeanor; publishing or using names obtained through such access for commercial or political purposes is a felony punishable by up to two years imprisonment with the Department of Corrections.
