Increases penalties for willful trespass on private land devoted to farming, ranching, or forestry from a maximum fine of $250 to $1,500, with restitution required for actual damages.

Raises penalties for second or subsequent trespass offenses from $500-$1,000 fine range to $1,500-$2,500 fine range, with possible jail time of 30 days to 6 months.

Increases minimum fine for entering such land with intent to commit waste, theft, or damage from $50 to $250, with maximum fine of $500 plus possible 30 days to 6 months imprisonment.

Maintains exemptions for peace officers, government employees, firefighters, emergency personnel, utility workers, railroad employees, oil and gas operators, and those with express or implied permission to be on the property.

Becomes effective November 1, 2009.
