Emergency departments cannot charge more than the community average charged by non-emergent health care providers for primary care services, as determined by the State Department of Health

The State Department of Health may impose fines equal to two times the excess amount charged above the community average for each violation

Legislative intent declares that emergency department charges should not significantly exceed charges for the same procedures in non-emergent settings

The cost of maintaining emergency departments should be shared by the community, not solely by emergency department users

Effective date: November 1, 2010
