SB 1380 Summary

• Amends 12 O.S. 2001, Section 66, relating to payment of costs in civil actions involving the State of Oklahoma and its departments or agencies.

• Modifies cost payment requirements by removing the exception for civil forfeiture actions, so costs from civil forfeiture actions will now be paid to the district court fund like other state actions.

• Clarifies that costs shall be paid from the first funds collected in satisfaction of judgments obtained by the state, except when funds are collected pursuant to child support orders or judgments.

• Requires prior notification to the district court clerk before any state action can be dismissed with unpaid costs.

• Effective date is November 1, 2010.
