Requires child care facilities to maintain liability insurance coverage of at least $200,000 per occurrence for negligence involving injuries to children in their care.

Mandates facilities unable to obtain required insurance coverage due to financial constraints or unavailable underwriters to post notice and notify the Department of Human Services of non-compliance.

Removes previous penalty language and establishes that failure to comply with insurance requirements is grounds for suspension or revocation of the child care facility license.

Exempts licensed child-placing agencies, licensed residential child care facilities, and Department-certified child care facilities from posting requirements, though the Commission may promulgate rules requiring insurance for these entities.

Becomes effective November 1, 2010.
