Amends 74 O.S. 2001, Section 3117 to clarify that agencies and state boards cannot establish or increase fees except when the Legislature is in session, unless specifically mandated by Legislature or federal law, or required by court order.

Excludes governing boards for entities within the Oklahoma State System of Higher Education from the fee restriction requirements.

Requires agencies to provide written notice to the Governor, Speaker of the House, President Pro Tempore of the Senate, and relevant legislative committee before establishing or increasing fees, including justification and supporting documentation.

Effective date: November 1, 2010.
