SB 1772 Summary

• Modifies definitions and organizational structure of the Board of Mental Health and Substance Abuse Services, including board member terms of seven (7) years unless reappointed.

• Expands regulation of behavioral health and substance abuse services through new certification requirements for peer recovery support specialists, eating disorder treatment programs, gambling addiction treatment programs, and opioid substitution treatment programs.

• Changes emergency detention period from 72 hours to 120 hours (5 days), excluding weekends and holidays, for persons requiring mental health or substance abuse treatment.

• Establishes confidentiality protections for investigation records while allowing summaries to be shared with specific entities including oversight agencies, facility administrators, and law enforcement when appropriate.

• Effective November 1, 2010.
