Summary of SB 1775

• Amends 41 O.S. 2001, Section 113a to require landlords to disclose in written rental agreements if premises have been flooded within the past 5 years or if prior methamphetamine manufacturing occurred on the property, if the landlord has knowledge of these facts.

• Requires such disclosures be made "prominently and in writing" as part of any written rental agreements.

• Entitles tenants to sue landlords in court for personal property damages sustained from flooding or the existence of prior methamphetamine manufacturing if the landlord fails to provide required disclosure.

• Defines "flooded and flooding" as general and temporary conditions of partial or complete inundation of normally dry land areas and structures from overflow of lakes, ponds, streams, rivers, creeks, and other inland waters.

• Effective date: November 1, 2010.
