SB 1860 Summary

• Amends 15 O.S. 2001, Section 598.5 to clarify language regarding injunctive relief for unfair sales practices violations.

• Changes "equitable jurisdiction" to "competent jurisdiction" in civil action provisions for persons injured by violations of unfair sales practices laws.

• Allows injured parties to seek injunctive relief, court costs, and actual damages from defendants who violate the unfair sales act or threaten violations.

• Permits separate damages-only actions in courts of general jurisdiction when injunctive relief is not sought, while prohibiting suits against newspapers, radio broadcasters, and advertising agencies that publish such advertisements.

• Becomes effective November 1, 2010.
