Expands charter school sponsorship eligibility to include federally recognized Indian tribes operating high schools under the Bureau of Indian Affairs, limited to native language immersion instruction within former reservation or treaty areas.

Removes the previous limit of three new charter schools per fiscal year in counties with populations exceeding 500,000 and eliminates the requirement for the State Board of Education to determine if new charter schools exceed enrollment caps.

Adds new sponsorship criteria allowing school districts with school sites on the school improvement list (under the Elementary and Secondary Education Act) to sponsor charter schools, in addition to existing criteria based on district size and population.

Authorizes charter schools created after the effective date to give enrollment preference to eligible students from schools on the school improvement list, in addition to preference for students within the school district.

Clarifies that administrative fees charged by sponsors of charter schools sponsored by higher education institutions or Indian tribes shall be limited to 5% of the State Aid allocation only, not other appropriated amounts.

Effective November 1, 2010.
