SB 1906 Summary

• Prohibits operation of motor vehicles while using portable electronic devices (hand-held phones, PDAs, laptops, etc.) when vehicle is in motion.

• Defines "using" as holding device while viewing/transmitting images, playing games, or composing/sending/reading emails or text messages; does not include turning device on or off.

• Establishes exceptions for emergency communications with 911 operators, hospitals, emergency services, and use by police officers, firefighters, and emergency vehicle operators in performance of official duties.

• Presumes device use if operator holds device conspicuously while driving, but allows rebuttable evidence to counter presumption; violation is traffic infraction punishable by fine of up to $150.

• Limits citations to situations where reasonable cause exists that operator violated other state traffic laws in addition to this section; effective November 1, 2010.
