Creates penalties for malicious intimidation or harassment crimes motivated by victim's race, color, religion, ancestry, national origin, or disability, including assault, property damage, and threatening violence as misdemeanor or felony offenses.

Requires Oklahoma State Bureau of Investigation to develop standardized hate crime data collection and reporting system for all state, county, city, and town law enforcement agencies.

Limits federal agency access to state criminal investigation records and restricts state employee cooperation with federal investigations under 18 U.S.C. Section 245, except when individual is convicted under Oklahoma hate crime statutes.

Protects hate crime data involving acquitted or dismissed charges by requiring permanent deletion from OSBI database and destruction of associated records.

Prohibits use of evidence related to free speech or religious assembly as substantive evidence in criminal cases unless directly connected to planning, conspiring, or committing violent acts.
