ENGROSSED SENATE BILL 2018 Summary

• Adds aggravated assault and battery upon a peace officer to crimes requiring offenders to serve at least 85% of their sentence before parole eligibility.

• Increases penalties for recruiting minors into criminal street gangs: first offense now carries up to 5 years imprisonment (previously 1 year) and up to $5,000 fine (previously $3,000); second offense carries 5-10 years imprisonment in Department of Corrections custody.

• Creates new felony offense for attempting or committing gang-related offenses as a condition of gang membership, with mandatory 5-year additional sentence on top of any other penalties imposed.

• Requires school employees to report suspected gang activity involving children under 18 to school superintendent and law enforcement, with immunity from civil and criminal liability for good faith reports.

• Effective date: November 1, 2010.
