OK SB2023

Amends 22 O.S. 2001, Section 991a relating to the Elderly and Incapacitated Victim's Protection Program regarding sentencing options for convicted defendants.

Deletes language that previously prohibited suspended sentences with probation for defendants being sentenced upon their third or subsequent felony conviction, or second or subsequent conviction under Section 11-902 of Title 47 (DUI offenses).

Restores judicial discretion to impose probation and suspended sentences for repeat offenders, except court may require electronically monitored home detention for second or subsequent DUI convictions unless the district attorney waives the prohibition.

Effective date: November 1, 2010.
