• Amends Oklahoma statutes (70 O.S. 2001, Sections 5-141.2 and 5-141.3) relating to teacher incentive pay plans in school districts.

• Clarifies language in existing incentive pay provisions by replacing "local" and "said" with "district" and "the" for consistency and modernization of statutory language.

• Removes requirement that Teacher Incentive Pay programs must have been evaluated by the State Board of Education as successfully completed before districts become eligible for state reimbursement of up to 50% of incentive awards (maximum $500 per teacher).

• Maintains existing provisions: incentive pay cannot exceed 20% of a teacher's annual salary, is not part of continuing contract, and is excluded from retirement calculations and FICA taxes.

• Effective date: July 1, 2010, with emergency declaration for immediate implementation.
