SB2191 Summary

• Establishes a new offense where persons previously convicted of malicious intimidation or harassment based on race, color, religion, ancestry, national origin, or disability face doubled penalties for any subsequent crime they commit.

• Applies the penalty enhancement only when subsequent crimes result in indictment or information being filed under the same statute (Section 850 of Title 21).

• Doubles the penalty for the crime(s) under which the person is ultimately convicted, making it twice the standard penalty.

• Effective date: November 1, 2010.
