OK SB2294

Amends 63 O.S. 2001, Section 2-402 to make penalty language gender-neutral by replacing "his" with "or her" in controlled dangerous substance possession statutes.

Modifies marijuana offense penalties by creating a new provision that second or subsequent violations involving one ounce or less of marijuana shall be a misdemeanor punishable by up to 1 year confinement and a fine not exceeding $1,000, rather than a felony.

Clarifies that unlawful possession of controlled substances includes any amount not obtained through valid prescription or authorization under Section 2-101 et seq. of the Uniform Controlled Dangerous Substances Act.

Maintains existing felony penalties for Schedule I and II substances (except marijuana), and misdemeanor penalties for Schedule III, IV, and V substances, with enhanced punishments for violations near schools, parks, or in the presence of children under 12.

Becomes effective November 1, 2010.
