• Creates an Electronic Monitoring Program requiring sex offenders registered under the Sex Offenders Registration Act to wear GPS monitoring devices as an alternative to incarceration.

• Establishes an annual $75 fee paid by registered sex offenders to fund the program through a new Sex Offender Electronic Monitoring Revolving Fund.

• Requires electronic monitoring for 10 years for certain sex offenders (with possibility of court petition for removal) and lifetime monitoring for those with subsequent convictions or who tamper with monitoring devices.

• Increases penalties for violating sex offender registration requirements from 5 years to 10 years imprisonment and implements a new $100/day fine for registration failures; persons returned to custody for non-compliance become ineligible for early release.

• Effective date: November 1, 2010.
