Amends 21 O.S. 2001, Section 30 regarding failure to perform duty by making language gender neutral.

Changes the statute to refer to "his or her" behalf instead of only "his" behalf when describing circumstances where a person cannot be punished for an omission.

Applies to situations where another person acting on behalf of the first person has already performed the required act and is competent by law to do so.

Effective date: November 1, 2010.
