SB 2313 Summary

• Authorizes the Department of Corrections Director to grant 60 days of reentry time credits to eligible offenders when the Governor declares a state of emergency within the department.

• An emergency exists when the offender population exceeds 95% of Board of Corrections authorized capacity for 30 consecutive days.

• Eligible offenders must be incarcerated for nonviolent offenses, classified as medium security or lower, and not serving time for second or subsequent offenses under Section 51.1 or Title 21.

• Reentry time credits apply only to offenders within 60 days of release.

• Effective date: November 1, 2010.
