Establishes waste tire recycling fees for tires sold by tire dealers and assessed at motor vehicle registration, with fees ranging from $1.00 to $3.50 per tire depending on rim diameter size.

Beginning July 1, 2010, implements a waste tire recycling fee of five cents ($0.05) per pound for agricultural equipment tires not exceeding 14 inches wide and 44 inches in diameter, with a minimum fee of $2.50 per tire; expands to all agricultural tire sizes beginning July 1, 2013.

Exempts customers who retain used agricultural tires for farm or ranch use from the recycling fee; allows tire dealers to pay fees on agricultural tires in inventory and include them in the recycling program.

Requires the Department of Environmental Quality to maintain a list of agricultural tire weights and make it available to tire dealers; directs waste tire facilities and TDF facilities to collect and transport agricultural tires according to the specified size requirements and dates.

Act becomes effective July 1, 2010, with an emergency clause for immediate implementation.
