Schools identified for improvement by the State Board of Education for four consecutive years must implement one of five alternative governance arrangements: converting to a charter school, replacing staff, contracting with a private management company, transferring control to the State Board, or implementing another major restructuring with substantial promise of improvement.

If a school fails to implement an alternative governance arrangement by the end of the school year following its fourth consecutive year of identification for improvement, the State Board of Education assumes control of the school's management, operations, and staff, and retains all funds that would have been allocated to the district based on the school's average daily membership.

Districts with average daily membership exceeding 30,000 may utilize alternative procedures when replacing staff, allowing teachers not retained to become full-time substitute teachers in the district for up to two years before potential non-reemployment.

Teachers serving as full-time substitutes under these procedures receive the same salary, benefits, and step increases they would otherwise be entitled to, and decisions regarding renewal or non-renewal are final and not subject to the Teacher Due Process Act of 1990.

The act takes effect immediately upon passage and approval as an emergency measure.
