HB 1044 Summary

• Amends 75 O.S. 2001, Section 303.1 to require agencies to cite federal or state law, court rulings, or other authority requiring adopted rules in their agency rule reports.

• Modifies 75 O.S. 2001, Section 308 to require legislative approval by joint resolution for any rule that establishes or increases fees or any rule adopted by agencies, boards, or commissions created by Title 59 of the Oklahoma Statutes.

• Rules establishing or increasing fees must be approved by the Legislature on or before the last day of the legislative session, or they are deemed disapproved.

• Adds new reporting requirements to agency rule reports including citation of mandatory authority for the rule and renumbers existing report components accordingly.

• Becomes effective November 1, 2011.
